Terms and Conditions

The harmonyhomes.io website and the Harmony Homes platform offer their users free Internet access to the information available at the time of their connection. These general and specific terms and conditions apply to all properties managed by HARMONY HOMES SAS (hereinafter 'HARMONY'), a simplified joint-stock company whose registered office is located at 11, rue de l'Académie, 67000 Strasbourg.

By contracting online, the customer declares full and unreserved acceptance of these general terms and conditions of sale. Validation of the order constitutes acceptance of these conditions. The data recorded by HARMONY on harmonyhomes.io constitutes proof of all transactions concluded between the parties. The data recorded by the payment system constitutes proof of financial transactions.

1. Prices

The prices indicated have been established based on the economic situation in effect at the date of booking. HARMONY reserves the right to modify its prices at any time. Stays are invoiced based on the rates in effect at the time the booking is registered.

Prices are inclusive of all taxes, expressed in Euros, per accommodation and per night, unless otherwise indicated. They include HARMONY service fees. All orders are payable in Euros. Rates are calculated for stays of a minimum of two (2) nights.

The rental rate includes the following services:

- Professional cleaning before and after each stay

- Fully equipped kitchen (appliances, crockery, utensils)

- Household linen provided (sheets, towels, tea towels)

- Practical guide to local experiences

- Family equipment on request (cot, high chair, children's equipment)

- Pool maintenance before rental (if applicable)

- Water and hot water

- Electricity, gas and heating, within the scope of normal domestic use

Heating and energy are included within the scope of normal and reasonable use. HARMONY reserves the right to charge for any manifestly excessive or abnormal consumption (heating kept on with doors and windows open, heating of a pool or spa beyond the period indicated on the property listing, etc.), based on the readings observed.

The rental rate does not cover the following additional services, charged separately:

- Early arrival (on request and subject to availability)

- Late departure (on request and subject to availability)

- Professional cleaning during the stay

- À la carte services: cooked meals, private chef, transport, and other personalized services

2. Reservation and payment

Online payment is secure. Payment is made by credit card directly on harmonyhomes.io or on any other partner booking platform. CB, Visa, Mastercard and American Express cards are accepted.

If the customer wishes to pay by another means (bank transfer, other credit card) or under other terms (a deposit for a long-term stay or a booking made well in advance), they must inform HARMONY management directly so that other conditions can be agreed. For any other arrangement, contact HARMONY. No reservation will be effective until receipt of the agreed payment.

For any reservation made via a partner platform (Airbnb, Booking.com, Abritel/Vrbo or any other booking site), validation of the reservation implies adherence to these Terms and Conditions. However, the platform's own conditions for payment, deposit and balance, security deposit and cancellation prevail over these terms where they differ, within the limits of the rules imposed by that platform. The house rules, the occupancy and capacity rules, the noise rules, and the damages and penalties regime provided herein remain applicable to any stay, regardless of the booking channel, to the extent permitted by the platform concerned.

Deposit: a deposit equal to 30% of the rental rate is required at booking.

Balance: the balance must be paid no later than 29 days before the arrival date. Otherwise, HARMONY reserves the right to cancel the reservation without refund of the deposit.

3. Group leader and data collection

As Harmony Homes properties are designed to accommodate groups, every reservation is made by a group leader (hereinafter 'the Group Leader'). The Group Leader is the natural person who made the reservation and whose contact details are recorded at the time of the order.

The Group Leader is HARMONY's sole point of contact for the duration of the stay. They guarantee compliance with these Terms and Conditions by all members of the group present in the property.

No later than seven (7) days before the arrival date, HARMONY may ask the Group Leader to provide the contact details of all adult members of the group (surname, first name, email address). In the absence of this list, the Group Leader is deemed the sole guarantor and jointly and severally liable for all members of the group towards HARMONY.

When the contact details of the adult members of the group have been provided to HARMONY within the required time, each of them is jointly and severally liable with the Group Leader for any damage caused to the property or any breach of these Terms and Conditions.

The personal data collected is processed in accordance with the applicable data protection regulations (GDPR) and the privacy policy available on harmonyhomes.io.

4. Tourist tax

The tourist tax is included in the displayed rates. Its amount is set by the relevant municipality, which has commissioned HARMONY to collect it from tenants and remit it to the municipality.

For reservations made via a partner platform, the tourist tax may be collected and remitted directly by the platform according to its own arrangements. In this case, it is not charged a second time by HARMONY.

5. Service fees

Service fees are included in the all-taxes-included rates displayed on harmonyhomes.io and on all partner platforms. These fees amount to 15% of the rental amount. They cover the provision of the platform, booking management, the payment service, the calendar synchronization service, and the services provided by HARMONY. Special commercial terms may be granted to certain customers upon written request and prior agreement from HARMONY.

6. Check-in and check-out times

Unless specific conditions are mentioned on the property listing or agreed in writing with HARMONY:

- The arrival time (check-in) is set at 4:00 PM.

- The departure time (check-out) is set at 10:00 AM.

Late departure: when no new arrival is scheduled the same day or the following day at the property, check-out may be made until 10:00 PM on Sundays and public holidays, subject to prior written confirmation from HARMONY.

Early arrivals and late departures outside these exceptions are possible on request, subject to availability, and may be subject to an additional charge.

HARMONY reserves the right to modify check-in and check-out times up to 48 hours before the start of the stay, and will inform the Group Leader as soon as possible.

7. Modifications to essential elements by HARMONY

Before the start of the rental, if HARMONY is required to modify one of the essential elements of the contract, the customer may, after being informed:

- Terminate their contract and obtain, without penalty, immediate reimbursement of the sums paid; or

- Accept the modification proposed by HARMONY.

A written exchange specifying the modifications may be sent to the customer on request. Any price reduction is deducted from the sums still owed. If the payment made exceeds the price of the modified service, the surplus is returned before the departure date.

In the event of illegal activities or established nuisances (lack of hygiene, noise pollution, aggressive behavior, etc.), HARMONY reserves the right to cancel the stay outright, without refund of the sums paid. In the event of physical resistance, law enforcement may be called.

8. Modifications by the customer

Once the reservation is confirmed, no date change is possible without application of the following conditions:

- Notice greater than 30 days before the arrival date: 30% of the total amount of the previous reservation remains acquired by HARMONY, to which is added the rate of the new reservation according to these Terms and Conditions.

- Notice less than 30 days before the arrival date: 100% of the total amount of the previous reservation remains acquired by HARMONY, to which is added the rate of the new reservation.

The customer may request cancellation of the original reservation, which will be subject to the cancellation conditions in article 9 below.

Any change in the number of participants must be communicated at least three (3) weeks before the arrival date, by email to support@harmonyhomes.io.

9. Cancellation conditions

Any cancellation must be made on the harmonyhomes.io website.

The cancellation fees retained are as follows (as a percentage of the total stay amount):

- Notice greater than 30 days before the arrival date: 30% of the total amount.

- Notice less than 30 days before the arrival date: 100% of the total amount.

No refund can be made if the customer does not show up at the times and place mentioned in the contract.

HARMONY exceptionally reserves the right to cancel a reservation within 30 days following its online booking for a legitimate reason other than those mentioned above. In this case, the customer will be refunded without delay.

HARMONY reserves the right to cancel any reservation in the event of a payment dispute, doubt as to the customer's solvency or identity, or risk of behavior likely to harm third parties or of illegal activity, without compensation of any kind.

10. Cancellation due to force majeure

In the event of force majeure making the rental impossible (in particular a national lockdown declared by the health authorities), the reservations concerned will be cancelled and the sums paid fully refunded. Date changes remain possible; additional fees may apply in the event of a change of season.

11. Security deposit and penalty schedule

Before arrival, a security deposit by credit card hold (not charged unless there is damage) will be requested via our partner Stripe. Its amount is set at EUR 1,000 for each accommodation.

The deposit is fully refundable within seven (7) days following departure, provided that the following conditions are met:

- No damage to the property or its contents beyond normal wear and tear

- No damage observed, where applicable, in the pool, spa or other basin due to non-compliance with the rules of use (food, drink and other prohibited products)

- No damage related to illegal activity or caused by animals

- All waste removed, crockery cleaned and put away in the cupboards or dishwasher

- All keys placed in the secure box

- All fees accumulated during the stay settled before departure

- No sheets or towels lost or damaged

- The tenant has not been evicted by HARMONY or by law enforcement

The Group Leader is liable for damage caused by misuse of the property. Repair or replacement costs will be deducted from the deposit as a priority, and invoiced additionally if the deposit amount is insufficient.

Penalty schedule. The amounts below constitute a flat-rate estimate of the costs incurred by HARMONY in the event of a breach of these Terms and Conditions. They are applied upon presentation of the corresponding supporting documents (sensor readings, photographs, reports, invoices), deducted as a priority from the security deposit, and invoiced additionally when they exceed the deposit amount. These penalties are cumulative, where applicable, with the deposit charges and travel costs provided below:

- Exceeding the authorized noise thresholds as recorded by the outdoor sensor: EUR 150 for the first episode, EUR 300 per additional episode

- Installation or use of personal sound equipment (speakers, microphones, etc.), indoors or outdoors: EUR 300

- Smoking or vaping indoors, observed in particular by the triggering of the detector following non-compliance with the smoking ban: EUR 350

- Property, outdoor accesses or courtyards left open on departure: EUR 100

- Keys not placed in the secure box on departure: EUR 100

- Waste not removed, crockery not washed or not put away: EUR 80

- Use of beds without the sheets provided: EUR 50 per bed concerned

Breakages, damage, losses (keys, household linen) and pipe blockages give rise to invoicing at the actual cost of repair or replacement, on presentation of supporting documents, in accordance with the above. No flat rate is applied in this respect, the loss being assessed at actual cost.

HARMONY reserves the right to collect:

- 100% of the deposit in the event of a serious breach of these Terms and Conditions (noise pollution, false alarm, inability to reach the tenants following sensor alerts, intervention by law enforcement, incomplete condition report, etc.)

- 50% of the deposit in the event of no response from the Group Leader during the stay

In the event of false alarms and/or travel following alerts from the noise sensor, calls from neighbors or intervention by the police, travel costs of EUR 300 will be charged to the deposit.

Any claim after collection must be made to HARMONY at support@harmonyhomes.io.

Our concierge service is available via WhatsApp during the stay for any emergency.

12. Traveler's insurance

The Group Leader undertakes to hold valid holiday civil liability insurance for the entire duration of the stay. This cover, generally included in comprehensive home insurance contracts, covers material damage caused to the rented accommodation.

The Group Leader undertakes to activate it and to provide a certificate at HARMONY's request. In the event of damage exceeding the deposit amount, HARMONY reserves the right to call directly on this insurance.

13. Condition report and inventory

The furnished accommodations are fully equipped with crockery, cutlery, bedding, household and bath linen, and appliances. It is expressly forbidden to use the beds without the sheets provided.

Verification of the rented premises may be carried out in the presence of the Group Leader or digitally. The Group Leader undertakes to leave the property in the same condition as on arrival, with the same furniture and equipment items.

14. Accommodations and occupancy conditions

All accommodations presented to customers comply with French safety standards and are regularly inspected. They are equipped for short-term stays. The maximum number of beds is indicated on each property's listing.

The accommodation may under no circumstances be occupied by a number of people greater than the headcount declared at booking, including day visitors. This limit also responds, for the properties concerned, to fire safety obligations related to their capacity. Any exceeding of the declared headcount entitles HARMONY to end the stay without refund and gives rise to a penalty of EUR 500, deducted from the security deposit in accordance with article 11, without prejudice to actual costs and the other sanctions provided herein.

The stay is strictly reserved for the accommodation of the declared group. The following are prohibited, except with prior written agreement from HARMONY: the organization of parties or events exceeding the registered group, the involvement of outside providers, the installation of demountable structures (tent, marquee, gazebo) and the use of sound equipment, in accordance with the noise rules of article 20.

The Group Leader may not sublet the accommodation, re-list it for rental or online, or use it commercially, in any form whatsoever.

The exact address of the property as well as the access codes and means are communicated to the Group Leader alone before arrival. They are strictly confidential and must not be disclosed to any third party outside the declared group.

15. Pools, saunas and spas

Pools, saunas and spas are not supervised. HARMONY declines all responsibility in the event of an accident. Constant supervision of children is required.

For outdoor pools, usability and water temperature are closely linked to weather conditions. Each listing will specify when the outdoor pools are heated and usable.

The temporary unavailability of a pool, spa, sauna or any other wellness facility, for technical, maintenance, sanitary compliance or weather reasons, gives rise to no refund, price reduction or compensation. HARMONY implements the necessary means to restore the facility as soon as possible.

16. Liability

HARMONY's liability cannot be engaged in the event of damage to or theft of personal effects in the accommodations. HARMONY cannot be held responsible for fortuitous events or force majeure, climatic disturbances, or external nuisances that disturb, interrupt or prevent the stay.

Any stay that HARMONY is obliged to cancel, in whole or in part, will result in the pro rata reimbursement of the sums paid, without compensatory indemnity.

In the event of noise pollution observed by the sensors or by law enforcement, HARMONY may end the stay. In the event of eviction and/or citation, the Group Leader may not claim any indemnity or refund.

Any stay interrupted by the customer, for any reason whatsoever, cannot give rise to a refund.

Minors under 18 years of age are under the exclusive responsibility of their parents or legal guardians. Customers are formally prohibited from entering areas reserved for staff or marked as inaccessible; any breach is at their own risk and peril, HARMONY disclaiming all liability.

17. Complaints

Any complaint arising during the stay must be reported immediately to HARMONY customer service in order to resolve the problem as soon as possible. If the problem cannot be resolved immediately, the Group Leader must send a detailed written complaint to support@harmonyhomes.io as soon as possible.

The customer may not claim any compensation in the event of urgent repairs carried out during their stay inside the accommodation. Complaints sent by SMS or made to the property stewards will not be taken into account.

18. Professional stays and events

Harmony Homes welcomes professional groups for seminars, team building, offsites and corporate retreats. These stays may be subject to a separate service contract specifying the specific terms (program, catering, equipment, personalized quote).

For the issuance of an invoice to a company, the Group Leader must provide, before the arrival date, the following information:

- Company name

- Billing address

- SIRET number

- Intra-community VAT number

No invoice can be issued if these elements are not provided before the start of the stay.

19. Pets

Pets are accepted with prior approval from HARMONY, for an additional amount of EUR 45 per animal and up to a limit of five (5) animals per stay. Pet owners are responsible for their animal and undertake to clean up its waste. Animals are not allowed in beds, on sofas, on furniture, or in pools and spas.

Any trace of animals on the furniture or in the pool may result in additional cleaning fees deducted from the deposit. Animals must be up to date on their vaccinations (including rabies) and treated against fleas and ticks within the three (3) days preceding arrival. These obligations are the sole responsibility of the pet owner.

20. Practical information

Internet access is available and free via the WiFi network available throughout the property. HARMONY cannot guarantee the continuity of the connection during the stay.

For security reasons, the outdoor accesses and courtyards of the properties may be equipped with video surveillance systems. Recordings are kept for ten (10) days, except in the event of a particular incident.

All properties are non-smoking indoors. It is forbidden to throw paper, wipes or sanitary towels in the toilets. In the event of pipe blockage due to non-compliance with this rule, unblocking costs are charged to the Group Leader in accordance with article 11.

Noise rules (non-negotiable):

- Playing music, the use of any sound system and any excessive noise audible from outside are strictly prohibited.

- It is forbidden to install personal sound equipment (speakers, microphones, etc.) indoors or outdoors.

- Each property is equipped with an outdoor noise sensor. Any exceeding of the authorized thresholds is sanctioned in accordance with the penalty schedule of article 11 and may give rise to the application of article 16.

In the event of severe storms, network/Internet incidents may occur and lawn maintenance may be temporarily interrupted. Some rooms close to the attic may show slight humidity; this characteristic is inherent to the old architecture of the properties.

21. Fraudulent reservations

In the event of a fraudulent reservation, all amounts that have not actually been collected cannot be deducted from the normal rental amount. HARMONY reserves the right to initiate any appropriate legal proceedings.

22. Photos and plans

The photos and plans of the properties available on harmonyhomes.io and on the partner platforms are not contractual. They are provided for indicative and illustrative purposes.

23. Exceptions

Any exception to the policies mentioned in these Terms and Conditions must be approved in writing and in advance by HARMONY. In the absence of written agreement, these terms apply by operation of law.

HARMONY recommends that its customers take out travel insurance covering cancellation and civil liability risks for the duration of their stay.

24. Competent jurisdiction

The parties expressly grant jurisdiction to the competent courts in Strasbourg for any dispute relating to the interpretation or execution of these general terms and conditions of sale.
